Alfredo Mochomo Beltran Leyva hangs hopes on appeal

Mochomo has filed an appeal. His legal team has grown to four attorneys.  And he has a good chance of being successful in appeals court.  What a win takes shape in, is difficult to speculate.  But, as it stands, he is doomed to leave prison in a pine box.  One would surmise anything besting that scenario is a win.

Alfredo “Mochomo” Beltran Leyva, was handed down a rare life sentence, that is Life Without Parole, he was 36 when arrested in Mexico, he will die in a U.S. prison.

Only 1/3 of 1 percent of all drug cases in a life sentence being imposed.    Most cases end with a deal being entered to and a favorable sentence given to drug offenders.  While the pragmatism of why deals make sense, is clear, the U.S. gives away too much, and too much of the time.  In addition to handing down sentences that are illogical and without parity. 

Years of investigations, tax funds, time and even lives freely expended on cases that only end anticlimactically with weak sentences.  Compounded by the ugly practice of using the criminals as cooperatives," testifying" in other drug cases.  
Too often testimony is lacking substantive evidence to support claims, just the good word of a really bad guy cutting a sweet deal. 

Alfredo got screwed, whereas every other narco big, including real monsters to humanity, cut deals.  Alfredo plead guilty, without a deal, adding salt to the wound, he was not given credit for his plea because “he did not accept full responsibility”.  He says he was a member working for his brother, responsible for shipments, not a capo.  U.S. says to the contrary. The U.S. wasn’t even after Alfredo, not named on indictments issued for BLO.  Not until after Arturo was killed and Alfredo was on track to end his prison sentence in Mexico.

Hunt of the Drug Enforcement Administration (DEA) New York Division. “This sentencing exemplifies law enforcement’s commitment to bringing justice to the victims of drug abuse through successful prosecutions of the highest echelon of drug traffickers. 
“Alfredo Beltran Leyva spent decades at the head of a criminal organization responsible for trafficking large amounts of cocaine and methamphetamine into the U.S.,” said Assistant Director Richardson. “Today’s sentencing marks an end to Alfredo Beltran Leyva's reign of terror, and demonstrates that the FBI and our law enforcement partners around the globe will aggressively pursue and bring justice to those individuals who use violence and intimidation to threaten our communities.”

Most federal prisoners will be released from prison eventually, but a small portion of federal offenders will spend the rest of their lives incarcerated. Some of these offenders were sentenced specifically to life imprisonment, while others were sentenced to a term of imprisonment so long that the sentence will often amount to a life imprisonment sentence regardless of the age of the offender. 

In most of these cases where the federal sentencing guidelines called for a lengthy sentence,  appear to have influenced the court to impose the sentence. In a substantial number of these cases, a mandatory minimum penalty also had an important role, by causing the  sentencing point/scale be determined under the sentencing guidelines, to be much higher than it would have been had no minimum penalty applied.

While these life sentences are imposed only a small fraction of the time (Federal) the impact is great and determined differently than all other cases.

Alfredo deseerved prison time, even he says that.  But when one compares to the criminality of others  who will one day be free, like La Barbie, who brought execution videos to Mexico, how can any reasonable person claim that is “best case justice” for the American people?

  2. The us public will only read the headline and say 'wow! The dea and FBI and boarder patrol are really earning their money. Making those Mexican kingpins pay for poisoning our children' very few people know about the cartels other then what the MSM tells them. And all they hear is chapo this, Sinaloa that, zetas this. It's obvious they're turning Alfredo into Arturo and making him pay the price for his brothers crimes. I'm not saying he's innocent or he doesn't deserve jail time, out calling him a kingpin and claiming he's the BLO mastermind, lol.

    2. @5:53 Good luck with that. Mochomo isn't going to get a deal. He's already been convicted. The government needs nothing from him for him to make a deal. You can't make a deal without leverage. He has none. He won't get some magical deal during appeal. The best he can hope for is life with the possibility of parole, which he currently does not have. More than likely he's going to die in a U.S. prison. It is what it is.

Alfredo formed FEDA so that they could take care of his older brother Arturo. Alfredo was in charge of keeping all of the cartel bosses and their families, safe. The Feds didn't even know anything about him. So the guy that set up him got caught and snitched on my friend. my friend got 30 years because he did not plead guilty. The snitched testified against him and the Feds brought another guy that he never seen or met and testified as well. The Feds invested too much time and money to lose. So they convinced the judge and my friend got fucked. The snitched was set to get 10 years anyways for what he had in possession at the time. He still ended up getting 10 years even though he snitched. The Feds want more people and more people.

      Readers Paci-Man chema) wants a big thanks for the bottom foto of abl. he says that is his uncle with abl, but turns out paci-man is not being truthful. and he wants money for pictures. I suggested Proceso or Reforma. while I am grateful, gifts like this come with too much baggage. We are an all volunteer team, and will not pay for any info or material. He says he is famous on BB because he posts real shit. I will leave that for your determination.
      as for the foto on the bottom. I did an extensive search and it was posted on a corrido the same day i received it but full length complete with shoes. I asked chema for a full scan to determine if it really was his property.
      He ignored the three requests for such a foto. and when I asked if I should blur his "uncles" face he said "no", rising suspicions the foto was not his. In essence wanting money for property belonging to others.
      Although ownership is not a prerequisite for sharing fotos, falsely stating one is not fair or ethical.
      I would not have told the whole story, but he is acting like a baby wearing a diaper with a full load. He did email and apologize this morning, but now is sending in batches of comments about credit for his foto. He wanted his name larger.

      well if you had the foto it is not imprinted anywhere or any social media etc. It is only shown 3 times, but cropped and in the case of VXT and browntown on forum who posted VXT image...only a third of the foto is shown on those fotos. the guy who has the original has it from the shoes up. it is common practice to cropped and keep one copy of the original to prove ownership. I have done that here at BB. I did so even with personal photos like the one of the santa muerte chapel on the book cover on the right of this page. I have the original to bunker for the book knowing we would get credit.

      the guy who had the foto has only rec 300 views. I am going to message him and get the scoop. I have contacted
      the abl camp who did not know about the foto.

      I was intrigued with the shoes the little guy was wearing.

He reports that although the sentence was stunning that "fredo" jis in positive and high spirits - and yes I did verify the cellie is who is represents himself to be.
