If you blinked, you may
have missed the defense’s case in the El Chapo trial. It is about enough for one to begin feeling a
bit of sympathy for the Sinaloa capo.
Whereas the government
was a song of overkill, the defense’s defense case was underwhelming at best, actually
it was non-existent. And it wasn’t that
they didn’t have a bit of arsenal in their defense bag. For me, it was a case of missed opportunities.
Speechless.
I have sat on multiple
criminal juries, just as I am sure some of you have. Can you imagine what is in the minds of the
jurors? Keeping in mind, jurors only
hear a portion of what is going on in court.
They must be very confused.
Defense Case
FBI agent Paul Roberts
took the stand.
He conducted a 2017
interview with Jorge Cifuentes, taking notes. Jorge is Alex’ brother and
testified before Alex.
Defense Attorney Jeffery
Lichtman zeroed in on ONE aspect from that interview.
The defense called only
one witness. And an antagonistic witness at that, an FBI agent.
In the notes taken by the
agent, Jorge said that in 2010 he met with a US intelligent officer who had a
USB stick loaded with evidence with respect to the Cifuentes-Villa/Sinaloa
Cartel investigation.
Lichtman offers that
Jorge tapped into that USB to present the story that prosecutors wanted to
hear.
Agent Roberts said his
notes showed that Jorge said he met with an Intelligence Officer. However, on
cross, prosecutors raised questions about whether the FBI agent was certain
Jorge said the officer was American.
Roberts was taking notes
by hand through a translator.
The agent was not happy being
there and surely did not want to help Chapo, this led to moments of argumentative
banter between the agent and Lichtman.
This led to Judge Cogan interjecting;
“Mr. Lichtman, he’s your witness.” This evoked
laughter from the jury.
And that is all she wrote
folks.
Judge Cogan sent the jury
home for the day. Judge Cogan will
conference with attorney for the remainder of the day.
The government will give
its closing on Wednesday. The defense in Thursday. Verdict watch could be as soon as Friday.

I do feel sympathy. Everyone deserves a shot to tell their story. I would've been confused if I was a juror. :x Defense gave the impression that there was nothing to defend. Why? Where are the experts? What the fuck happened????? ;[
ReplyDeleteI bet the defense did this on purpose for the appeals process. They will claim that all the judges motions regarding who they could call to the stand and what they could talk about will be used to argue they didn't have a fair trial.
DeleteThese motions and rulings though could have been intentional by the prosecution and the judge knowing that even if his appeal works he will simply be retried, allowing the prosecution to prepare more for what the defense wanted to do.
On a side note as an american. Though I believe Chapo is guilty I an not happy with how the judge restricted chapo's defense during the trial but i have no problem with how they restricted access to him before as he showed himself to be a danger to the fairness of the trial (influencing/intimidating jurors) and a danger of escape (it does matter if you think he couldn't have escaped, he may still have tried and in the process harmed people).

Imagine bin Laden going to trial in the US. Same scenario. Even if a defense could miraculously get him off the judge wouldn't allow the verdict. And yes a judge can do that. The judge in the Dahmer case stated years after his retirement that would have dis-allowed a NG verdict. These cases are not like Casey Anthony or Michael Jackson where there is doubt due to lack of evidence.

I thought it would be a good idea to see where we were-- so I proposed a vote right off.
I was absolutely stunned to see a 6/6 split!

DeleteI too served and was the foreman.. Yes its stunning to see splits but what is more stunning is seeing people change their mind after deliberating. Its really tough because as a Jury you have to be neutral. Listen to all the facts and then put it together depending on the counts given. We all know Chapo is guilty but as a Juror you have the responsibility of being neutral and looking at actual facts/evidence. OJ is one sample.

The Chapo trial, would cast a huge spot light, not on “race” but on the Drug issue and gruesome violence behind it, which the “main stream media” rarely covers because doing so would point to the American appetite for Drugs.

The past tends to repeat itself and if you look at Capos who have lived long enough to be On trial by the U.S. you will see that none of them defend themselves. They can’t. In order for loved ones to continue operating in Mexico and in order for them to keep their contacts and suppliers the patriarch, in this case chapo, has to take one for the team. Just like all those that testified against him did so knowingly and with his acceptance, that’s why you see the acknowledgments in court or the gestures of friendship. On here you see the uneducated calling people rats and snitches, but it’s about protecting the organization. His sons will soon have their inner circle back in Mexico within 10 - 25 years and support since their father did not testify or burn any of their contacts. Do you really think El Mayo is hurt that his sons talked about dad? No it’s all about getting out and back to business. El Chapo is a wealth of information on a masssive network and probably evidence to prove it, but that would spell instant death for his entire blood line and what does that achieve? A lot of uneducated comments on here. In America everyone snitches for self preservation, but in Mexico, especially in this case, it’s all about the organization.

DeleteGovernment has the burden to prove Chapo's guilt beyond a reasonable doubt, the burden never shifts to the defense, and the presumption of innocence alone is enough to acquit the accused if the government's case falls short of proof BRD. Reasonable doubt can come from any part of the evidence- from the government's case, the cross examination of the government witnesses, or from the defense evidence or witnesses. Some of you believe as though the accused has some burden.
