El Chapo Trial: If you blinked you may have missed the defense's case

Chivis Martinez Borderland Beat with material from keegan hamilton

Prosecutors = 11 weeks, 56 witnessesThose defending a man fighting for his life? One hostile witness for less than 30 minutes

If you blinked, you may have missed the defense’s case in the El Chapo trial.  It is about enough for one to begin feeling a bit of sympathy for the Sinaloa capo.

Whereas the government was a song of overkill, the defense’s defense case was underwhelming at best, actually it was non-existent.  And it wasn’t that they didn’t have a bit of arsenal in their defense bag.  For me, it was a case of missed opportunities.

Speechless.

I have sat on multiple criminal juries, just as I am sure some of you have.  Can you imagine what is in the minds of the jurors?  Keeping in mind, jurors only hear a portion of what is going on in court.  They must be very confused.

And they are not alone.
Defense  Case

FBI agent Paul Roberts took the stand.

He conducted a 2017 interview with Jorge Cifuentes, taking notes. Jorge is Alex’ brother and testified before Alex.

Defense Attorney Jeffery Lichtman zeroed in on ONE aspect from that interview.

The defense called only one witness.  And an antagonistic   witness at that, an FBI agent.

In the notes taken by the agent, Jorge said that in 2010 he met with a US intelligent officer who had a USB stick loaded with evidence with respect to the Cifuentes-Villa/Sinaloa Cartel investigation.

Lichtman offers that Jorge tapped into that USB to present the story that prosecutors wanted to hear.

Agent Roberts said his notes showed that Jorge said he met with an Intelligence Officer. However, on cross, prosecutors raised questions about whether the FBI agent was certain Jorge said the officer was American.

Roberts was taking notes by hand through a translator.

The agent was not happy being there and surely did not want to help Chapo, this led to moments of argumentative banter between the agent and Lichtman.

This led to Judge Cogan interjecting; “Mr. Lichtman, he’s your witness.”  This evoked laughter from the jury.

And that is all she wrote folks.

Judge Cogan sent the jury home for the day.  Judge Cogan will conference with attorney for the remainder of the day.

The government will give its closing on Wednesday. The defense in Thursday.  Verdict watch could be as soon as Friday.

From the conference; Off limits in closing arguments by the defense:  Can’t claim that there is a conspiracy between El Mayo/U.S./Mexico

They can however that El Mayo benefitted from El Chapo’s notoriety

The defense better hit a home run in closing.  But don’t wait to exhale.

  1. I do feel sympathy. Everyone deserves a shot to tell their story. I would've been confused if I was a juror. :x Defense gave the impression that there was nothing to defend. Why? Where are the experts? What the fuck happened????? ;[

    1. I bet the defense did this on purpose for the appeals process. They will claim that all the judges motions regarding who they could call to the stand and what they could talk about will be used to argue they didn't have a fair trial.

These motions and rulings though could have been intentional by the prosecution and the judge knowing that even if his appeal works he will simply be retried, allowing the prosecution to prepare more for what the defense wanted to do.

On a side note as an american. Though I believe Chapo is guilty I an not happy with how the judge restricted chapo's defense during the trial but i have no problem with how they restricted access to him before as he showed himself to be a danger to the fairness of the trial (influencing/intimidating jurors) and a danger of escape (it does matter if you think he couldn't have escaped, he may still have tried and in the process harmed people).

    2. Yep..this is all set for a big appeals case. Im surprised the BB writers dont have more experience than this. Big capos never have good defense anyway. Look at the trials of the Cali cartel leaders..they had all the money in the world and barely put up a fight Miguel is doing 50 yrs and Gilberto life.

  4. What's to be expected when government is pulling all the strings? Testimonies are biased and unfavorable against the accuser. Where highly classified information and information are being withheld by government.
Its plain to see how Mayo's son Vincentillo literally had an agreement with US officials and was not honored by deniability.
He was toast from the get go when in US custody.
Everyone as a defendant has a right to a fair trial. Despite his role and complicity of the alleged crimes.

Something's are and will be kept secret as to how due process really is applicable.

  12. Chapo is guilty without any doubt. The murder and torture alone deserve MANY life sentences. Sure they can go thru the motions of a defense but really what is the point? Imagine bin Laden going to trial in the US. Same scenario. Even if a defense could miraculously get him off the judge wouldn't allow the verdict. And yes a judge can do that. The judge in the Dahmer case stated years after his retirement that would have dis-allowed a NG verdict. These cases are not like Casey Anthony or Michael Jackson where there is doubt due to lack of evidence.

    2. Easy to answer... Chapo was protecting Los Menores AND AND AND pre agreements....find out ALL the info the government had on the cartel so they can squeeze out the snitches currently working within. Come on guys, how can you not see what happened here??? It was a farce and CDS play from the beginning. Also, remember what I said 3 months ago and take note. It's about to be one cartel ruling Mexico and it aint those perros CJNG. Get in line folks, the old timers are lining everyone up. Just watch. Facts

    3. 11:49; I don’t think that saving money was anywhere in Chapos calculas. Between legitimate incomes alone; like real estate rents in Culiacan, Mazatlan, Guadalajara Chapos family is netting tens of million each month. If you want to see how these guys and the thousands of others live who you will never hear of, go to Mazatlan for Semana Santa (Easter week) and you’ll see CDS money and independent cartel money everywhere. Exotic luxury cars, their body guards in matching range rovers, and these guys buying the bar and hiring several banda groups at a time to play everywhere they go. The smarter money is so well insulated with legal cash flows cleaned 2x and 3x from being raw drug money. I can assure that Chapo or any other significant CDS operator would have no problem getting a “loan”, gift or whatever you want to call it to pay legal bills that are going to be scrutinized by the US government.

There are other families in 1st and 2nd position. If you haven seen the future, CJNG isnt nomber 2, they’re #1. Not a fan of either but you have to be kidding if you thing this is some sort of smart play. Chapo sacrificed himself now only because emma was implicated. He now is giving up to protect the twins. Nothing to do with menores. They’re actually turned him in.

    5. 2:29,
You don't know anything obviously. I'll just keep it at that. You have no idea. It's not just the kids, it's the whole Mafia being protected and making sure the government releases as much info as they had on chapo to clear out the snitches in Mexico. If you think CJNG is #1, your not that bright. Maybe number 1 in gas stealing and attempting to take plazas but not number 1 in the world. The roots run deep in Sinaloa and not just one or two families pal. Do your homework and come back.

    6. 6:26 You are correct. The reality is CDS drugs generate sales returns of wholesale distribution revenue daily as hubs in LA, Chicago, NYC, Austin, Dallas Houston, ATL, and NYC are reached. Then CDS has a distribution network to middle market and small market higher margin sales that follows every large load taken to a CDS distribution hub. Nobody has ever controlled the distribution channels as deep and geographically vast as CDS does. This well developed distribution and laundering infrastructure is on auto pilot and every day is generating more money than all cartels together while also forming a loyal customer base because of timely delivery and quality.
Chapos innovative supply and distribution channels will be the primary source for US noses and veins long past his time on earth.

Don't bother holding your breath at all. It doesn't matter what the defense says in their closing. He's going to be convicted. Everyone knows it. Everything in between now and then is simply everyone involved going through the required motions. He's done and was done before the trial even began.

    1) defense lawyers are highly confident that an appeal due to some technicality or other reason will work so no need to expend resources and money now

  21. Today I am remembering my first gig as a juror.

When we went into deliberations, first assignment was to pick a foreman--that was yours truly. Probably because I took copious notes during the trial.

I thought it would be a good idea to see where we were-- so I proposed a vote right off.

I was absolutely stunned to see a 6/6 split!

I thought it was so clear and everyone would see it the way I did.

      Delete
    3. I too served and was the foreman.. Yes its stunning to see splits but what is more stunning is seeing people change their mind after deliberating. Its really tough because as a Jury you have to be neutral. Listen to all the facts and then put it together depending on the counts given. We all know Chapo is guilty but as a Juror you have the responsibility of being neutral and looking at actual facts/evidence. OJ is one sample.

      Delete
    4. I did enjoy the experience. I did not want to go the first time. but everyone should serve when called. It is the best learning experience. you see the integrity of the system and recognize some flaws, but bottom line if good people shy away, then our juries become inferior. my children have served. ...

      Delete
    5. I did not want to be foreman, because it was my first time serving on a jury. and our jury hung because of ONE juror who had preconceived beliefs against Mexicans--and she was a Mexican. "I grew up with THOSE people." what a POS she was. but it was my only hung jury.

Some people come together, others can be bullied.

    4. 12:34. Good points regarding OJ.

His trial was after Rodney King, and initial aquital of white cops. The racial component (accomplished black athlete who dumped his first wife who was black, for a hot White Blond), along with the court room theatrics, and wall to wall coverage every day via a live feed to the entire county, made the OJ trail, the so called “trial century.” I recall some people going into withdrawal after it was over.

The Chapo trial, would cast a huge spot light, not on “race” but on the Drug issue and gruesome violence behind it, which the “main stream media” rarely covers because doing so would point to the American appetite for Drugs.

  37. The past tends to repeat itself and if you look at Capos who have lived long enough to be On trial by the U.S. you will see that none of them defend themselves. They can’t. In order for loved ones to continue operating in Mexico and in order for them to keep their contacts and suppliers the patriarch, in this case chapo, has to take one for the team. Just like all those that testified against him did so knowingly and with his acceptance, that’s why you see the acknowledgments in court or the gestures of friendship. On here you see the uneducated calling people rats and snitches, but it’s about protecting the organization. His sons will soon have their inner circle back in Mexico within 10 - 25 years and support since their father did not testify or burn any of their contacts. Do you really think El Mayo is hurt that his sons talked about dad? No it’s all about getting out and back to business. El Chapo is a wealth of information on a masssive network and probably evidence to prove it, but that would spell instant death for his entire blood line and what does that achieve? A lot of uneducated comments on here. In America everyone snitches for self preservation, but in Mexico, especially in this case, it’s all about the organization.

    3. For what you wrote to be true it would mean Ivan and Alfredo are going to be around for 30 + years. Hate to break it to you but that ain't going to happen. No other capo of that rank has been kidnapped lmao I give them 10 years maybe and that's a huge maybe. The mayo line will continue. The chapo line will continue with ovidio, most of you people dont know anything about him other than hes chapos son. At the end that's how it's supposed to be. Back to the basics no more stupid corridos and stupid novelas. The only people that should know the mafia business is the mob!!! I can't believe these outsiders are allowed to know even the most minuscule of information, it baffles me. Guarsntee either ivan and co get in line or they're done they dont hold clout like that MZ does. All you people that are just fans of this I laugh at u. I compare u ppl to kindergardeners talking about politics and the stock market. Enjoy the novelas and corridos but just remember this, you can watch all the novelas and listen to all the komander u want at the end of the day yous all wake up in the morning to go punch in the clock. Asi es que abrense ala verga!

  39. Government has the burden to prove Chapo's guilt beyond a reasonable doubt, the burden never shifts to the defense, and the presumption of innocence alone is enough to acquit the accused if the government's case falls short of proof BRD. Reasonable doubt can come from any part of the evidence- from the government's case, the cross examination of the government witnesses, or from the defense evidence or witnesses. Some of you believe as though the accused has some burden.

  41. WTF Chivis ? Who would you suggest he call for a witness ? Anybody connected with him is either a cop or a drug trafficker . The traffickers in custody are testifying against him . If the others come forward they will be arrested . The only other people familiar is investigators. Sympathy ? You can find it in the dictionary someplace between shit and syphilis . I have Sympathy for a rabid dog . His disease is totally not his doing , unlike Chapo . Best regards Chivis . Our opinions may be different but you have covered the trial well . Thanks
