El Chapo Trial: Questions from deliberating jurors

Full roundup of today's deliberation 

Jury asks to leave at 4:15pm.  Looks like they are nowhere near a verdict-

I wonder what the prosecution is thinking right about now? No worries yet—it just demonstrates the jury is working it.  Good for them.  [jury dismissed for the day] 



Note was sent asking for four things:

1) The transcript of a phone call regarding "ice/meth" 
May be played for the jury but more likely given the printed translated narrative of the call

2) Testimony from Rey Zambada re: "Chispiro," who supplied the cartel with ephedrine
They seem hung up on the ephedrine aspect

3) Full testimony from Alex Cifuentes
Wow…This is massive

4) Full testimony from Jorge Cifuentes
Ditto

These are indicators that this jury is carefully evaluating the evidence.  Not a slam dunk.  It would appear at least one juror is not convinced the U.S. proved the meth conspiracy charge.  Typically the foreman will ask help from the court if the empaneled can’t unanimously reach a decision. 
The jury asked for all of Cifuentes testimony-but only part of Vicente Zambada’s


The jury has just asked for the full testimony of Juan Aguayo, he is one of the agents who testified.  He testified about 400 kgs or so of marijuana being seized near San Diego. [would have never projected that request]


The Cifuentes testimony has to be prepared, meaning redaction, causing sidebar back and forth, sustaining and objections.


The foreperson is a young Hispanic female 


Jurors are given notebooks to take notes.  They can ask for as many needed.  They are not allowed to take them when court adjourns.  From personal experience unless you figure out a system of reference the notes will be useless later.


My system was simple; Fold a page in half then create an angle, this becomes a tab to write subject such as “forensic testimony” 

From Alan Feuer inside the courtroom:

The judge said he was inclined to simply give jurors the printed pages rather than spending 3 to 5 days--yes, 3 to 5 DAYS--reading back that testimony.

The jury also asked for a  phone call [to be played] in which meth is discussed and for "Rey" Zambada's testimony concerning his own role in buying ingredients for meth production. This interest in meth squares with their note from yesterday asking about ephedrine, a precursor to meth.

  1. I’m glad they’re taking their time to go over all counts. From what I’ve read here, I’ve realized no one views this trial the same 😐 so we might get a verdict or we might have a hung jury. Nothing is certain. No matter how guilty or innocent he looks to any of us.

    If my memory doesn’t fail me only one state in the US doesn’t require unanimous verdict. For sure NY isn’t it

    1. Funniest shit I’ve heard all trial: Jurors taking long so they won’t have to go back to work this week!

      Apparently there’s some jobs that pay you while you are in jury duty 🤨

      I also saw on the news that each juror was receiving $40 (if I’m not mistaken). Imagine being unemployed receiving $200 weekly... I would drag it out too lol

  3. You could toss both Alex and Jorge cifuentes testimonies and still get a conviction on Pedro's testimony along with tapes he made. They did both admit they were liars.

  6. The defense attorneys didnt even object like they should have, for example why did Damaso get away with ratting on Chapo's wife helping Chapo escape ? That was revenge against her and Chapo plain and simple.
    What did that have to do with any charges ? That discredits Damaso's testimony as having bias, he was a trick who got exposed as a double agent.

  13. Even if El Chapo is found innocent or hung jury/mistrial, no way is he walking out of there onto the streets of New York. Remember they've been guarding him with DefCon 5 security at no small cost. He'll get hit with another trial in one of the other US cities where they have built cases. They're not going to send him back to Mexico, no way, although that would be Chapo's absolute best case, in his dream all the henchmen are standing by right now to file amparos, dig tunnels, etc.

    As Chivis pointed out - he could have just said "your honor I'm guilty, I ran the racket and I'm here to take the fall. Where's my cell?" and left the door open for future snitching in exchange for reduced time. or he could have negotiated with the prosecution and snitched out everyone (as if they needed him to rat on Mayo, Azul, Chapitos, etc.)or he could plead innocent and take his chances.

    Remember how it was said that Mexico was afraid to extradite Chapo because they were scared he'd snitch on all the money/mordidas paid to all the generals and politicos? In effect the prosecution did that for him. What difference would it have made if he would have testified against not only his cartel partners but all the big biters?

    And lastly - what do you really think El Mayo wants? What value does Chapo have to him now? Would he benefit if Chapo were out of the picture? Just sayin

    It's Mexico so we'll never really know, you know...quien sabe
