Mexico court rules cocaine use is ok: " in adults does not pose a significant health risk"

A judge from Mexico City granted two amparos that order the Federal Commission for the Protection against Health Risks (Cofepris) to authorize the possession, transport, use and use of cocaine, excluding the all trade act

The amparos were granted to members of the Mexico United Against Crime organization. "Cocaine use in adults does not pose a significant health risk, except in the case that it is used chronically and excessively," said Víctor Luna Escobedo, Tenth District Judge in Administrative Matters.

“This moderate consumption is up to half a gram daily, it must be in private spaces, without the presence of minors, without being able to take to work, drive vehicles, incite third parties or handle dangerous instruments or machines.

"Cocaine intake or consumption may have different purposes, including stress relief, intensification of perceptions or the desire for new personal and spiritual experiences"

Judgment of amparo 1205/2018 from  Judge Víctor Luna

Luna was based on the "positive" parts of a report rendered in December by the National Commission against Addictions that, when referring to the effects of low-dose cocaine use, listed:

"Improvement of mood, increased energy and reduced fatigue, increased muscle performance, decreased appetite, desire to speak, increased sexual desire, transient increase in self-esteem, anger and verbal aggression, increased blood pressure, increased heart rate. "

It is the first such ruling related to a drug other than marijuana, but the judge used exactly the same arguments that the Supreme Court of Justice of the Nation (SCJN) has wielded since 2015 to grant amparos that allow the recreational consumption of the cannabis

Conadic also detailed the effects of excessive dose consumption and chronic cocaine use, but the judge put them aside, as he argued that not every consumer is a drug dependent.

"The moderate consumption of cocaine may not generate addiction," he added when declaring the absolute prohibition for this drug, provided for in the General Health Law, unconstitutional, as it is considered a disproportionate and unnecessary measure to protect health and public order.

Luna's sentence will not take effect while it is reviewed by a collegiate circuit court, which could request the intervention of the First Court Chamber to clarify whether its criteria on marijuana - which it put in the same plane as alcohol or tobacco- are applicable to other

In 2017, marijuana was legalized for medical and scientific purposes, and in November 2018 the Supreme Court ruled that a blanket ban on recreational use was unconstitutional, Reuters reports.

That same month, López Obrador's government submitted a bill that would allow recreational use and create a medical marijuana industry, according to Reuters.

For now, Cofepris grants permits to use marijuana on an individual basis.

  2. How about Heroin? I've dealt with a large number of Heroin users and could not discern any significant health problems among the addicts.

    What you see in the before and after pictures depicting the transition of a healthy individuals to one who is nothing but shriveled skin and bones is not the result of the heroin, but rather the result of not eating or meeting basic health needs because the addict spends whatever money he has (or steals) to get his daily fixes.

    It goes without saying that a person under the influence of heroin should never get behind the wheel of a car. But you can say the same thing about a person under the influence of pot, cocaine, meth or any number of other drugs, including some prescriptions.

    It is my opinion that the long-term use of pot is far more deleterious to one’s health than the use of heroin, and the results of some studies back that up.

I broke my neck, got hooked on opiates, my script was cut off and I moved to Heroin. In the 6 years I was an addict i kept a good job and didn’t ever beg, borrow, or steal to support my addiction. If for some reason I couldn’t afford to get well I’d just go sick before stepping on people and/or my moral compass as this is my problem and nobody else’s. Not every addict does shady things to support their habit. Just like not every gun owner is out there committing drive by shootings.

ElGrandeRojo - yeah it really is everywhere, every class, demographic, etc. There were a lot of people I met over the years that the average person would have never thought was an addict, good family life, successful careers, just overall stand up people... but they were addicts and you’d never know based on the kind of person they were and the life they lived. It’s kinda like with cannabis, how up until the last 10 years people thought all pot smokers were lazy couch potatoes. When in reality some of the most successful hardworking people in the world are cannabis users. I mean hell, that’s why I use the name “Phelpso”, in honor of Michael Phelps, aka mr big lungs haha.

      But overall I do feel super fortunate to be away from all that shit. Even though I lived what seemed to be productive life on the outside. I’d stopped growing as a human and watched idly by as my soul slowly diminished on the inside.

      Now days, I’m perfectly happy with cannabis, booze, and the occasional psychedelic trip.

You will get a rx for acute pain for something like post surgery or broken bone. and usually no more than 30 days. chronic pain sufferers eg cancer, medical condition etc will be referred to a pain doc. He/She will access your records, mri, tests etc and make a decision to take you on as a patient or not.

      He will set the course for pain relief, which will be a combination of treatments such as PT, steroid injections, non narcotic meds and pain meds. The doc is meticulous in his reporting to DEA. and required to do so.

      the doc is require to conduct urine tests to have a watchful eye if the patient is using other drugs. and a check each month with pharmacies to see if patient is doc shopping.

      I support this medicine protocol of pain docs for chronic pain suffers.

      Yeah I understand it on both fronts. I’ve experienced chronic pain in my neck since I broke it and around 2014-2015 it became near impossible to get what I needed so I turned to the streets.

      Now fast forward and I’ve been clean since March of 2017. Unfortunately, three and a half weeks ago I shattered my ankle and they had to put 10 screws and a plate in. They gave me enough pain meds for a few days(to sleep) then it was just iburophen and Tylenol. If this happened in 2010 I’d still be on pain killers. But I do feel fortunate, I gave my pills to my mom to give to me so I didn’t abuse them, and it didn’t make me want to relapse at all. Even in as much pain as I’m in I’m as committed as ever to staying clean 💪

I as a mota seller believe drugs should be decriminalized. Tax them, regulate them. It'll be hard. Even here in the legal NW, the black market for pot is huge. I get shady rednecks come to my shop all the time trying to sell me stuff on the sly. I never do. Why risk incarceration, for something I do well at legally. We just have to collectively figure out how to curb the violence. People have proven for years they are gonna use regardless of legality. Might as well tax it, and try and make sure it's done safe as possible.

    The ruling means the unnamed pair can use, but not sell, small amounts of cocaine, according to Mexico United Against Crime (MUCD), an NGO that filed legal papers in the case as part of its strategy to change the country's drug policy.

  37. Please read Roberto Savino's book "Zero-Zero-Zero" (Penguin, 2016). It provides relevant insights that, to me, suggest the Mexican Judge has be compromised by unseen forces to rule as he did.
    I am with Sol on this based on years of clinical experiences with drugs addicts off all kinds.
    Roberto Saviano's book might cause you to see coke in different way.

  39. Ive used desoxyn for years for adhd i only use it when i need it but when i dont have it I have no desire to use crystal meth . Desoxyn is pharmacutical methamphetamine much cleaner then anything on the street .But it def helps when I need it . I dont abuse it or tell ppl I have it but without it life would be a lot harder to deal with it actually mellows me out and gives me a deep focus and it really does feel good . I think there is a place for all drugs it comes down to will power and moderation some have it some dont .

    1. As with anything, Moderation works. But, most humans don't do anything in moderation, and proven highly addictive substances are tough for anyone to sustain moderation with.
