The defense of Emma Colonel Aispuro and the prosecutors of the District of Columbia Court requested that the date on which the sentence against Joaquín Guzmán Loera's wife, El Chapo, be postponed for 30 days.
According to U.S. authorities, the former model would be formally convicted on September 15, after having pleaded guilty to three counts related to drug trafficking, but by the new motion it is proposed that it be until October 14.
"In light of other obligations that have arisen in the meantime and the nature of this case, the parties believe that additional time is needed to properly prepare for the judgment," it was argued in the document presented on August 27.
Mariel Colon Miro and Jeffrey Lichtman, lawyers for Colonel Aispuro, signed the petition addressed to Judge Rudolph Contreras along with Arthur G. Wyatt, head of the Narcotics and Dangerous Drugs section; Katherine A. Wagner, litigant of the case; and Anthony J. Nardozzi, from the Criminal Division of the Department of Justice.
The letter clarifies that both Emma Coronel and the prosecutors received a draft establishing the sentence proposed by the probation officer. This investigation is scheduled and will be useful in preparing memorandums that help in the final determination.
"The government has presented its objections to the Probation Office, and the defendant is preparing her objections and anticipates presenting them soon," said the defense and officials.
This shows that the parties are not satisfied with the years set in the project and need more time to reach an agreement.
Accordingly, it is also requested to reschedule the deadline for submitting memorandums, at least seven days before the proposed judgment date, while the responses would be known 72 hours before the same extension. The order scheduling sentences of July 20 indicated that objections should be until August 25.
However, it was also foreseen that there would be some other provisions such as memorandums to assist the project, which should be vented by September 7 and all responses would be delivered a week later, on September 13. Therefore, there is no room for out-of-time procedures and it only remains to wait for the admission of the Court.
A statement of facts published by the U.S. authorities describes complicity of a woman benefited for 14 years with illicit profits, as a result of the sale of drugs.
Although she also realizes someone who received orders, had meetings with high-ranking criminals, bribed corrupt officials and was aware of her role within the transnational criminal organization. According to the Guilt Agreement that was public, the first charge against Colonel Aispuro is punishable by a minimum penalty of 10 years and a maximum of life imprisonment. While the second indictment, corresponding to money laundering for profits from the sale of drugs, carries a sentence of 20 years behind bars, as well as penalties of $ 500,000 or double the value of the property that involved that financial transaction.
Emma Coronel also accepted her involvement in transactions and businesses with Chapo Guzmán's properties, because in this way she sought to evade and avoid prohibitions on someone previously designated as a high-level drug trafficker. For this reason, the highest penalty is 10 years in prison and a fine that does not exceed 250,000 dollars.
Unlike the accusation presented on March 25, the authorities updated in the denunciation of facts of June 10 a decrease in the time of participation in two of the charges against the one from Canelas, Durango. For conspiracy for drug trafficking, it was considered from 2011 and not 2007, until January 2017. Regarding the imputation of money laundering, considerations also decreased and the charges were for six years.
Emma Coronel was arrested on February 22 of this year when she arrived at Dulles-Washington Airport. After her appearances and not being offered bail, she was held in the Alexandria Detention Center, where she has suffered precarious conditions to date. She is expected to reach minimum sentences and there is suspicion in her case for the information she was able to provide in exchange for spending a few years in prison
