FGR Charges 83 Linked to Ayotzinapa Student Case including Military Commanders & a Former Prosecutor

"Socalj" for Borderland Beat

The Truth Commission has resulted in numerous arrest warrants surrounding the case of the disappearance of the 43 normalistas from Ayotzinapa in 2014.

The Attorney General's Office (FGR) obtained 83 arrest warrants against 20 military commanders and troop personnel in Iguala, Guerrero authorities; state police, municipal police, and 14 members of the Guerreros Unidos group, linked to the Ayotzinapa case. These arrest warrants stem from the recent report from the Truth Commission that contradicts many aspects of the disappearances of 43 students in 2014 put forth by earlier officials.

Through a statement, the FGR detailed that the Second Judge of Federal Criminal Proceedings in the State of Mexico, based in Toluca, issued 83 arrest warrants against the military commanders and troop personnel of the 27th and 41st battalions in the city of Iguala, as well as five administrative and judicial authorities of the state of Guerrero; 26 police officers from Huitzuco; six from Iguala and one from Cocula; plus 11 state police from Guerrero and 14 members of the Guerreros Unidos criminal group.

He pointed out that they are all linked to what happened in the city of Iguala, Guerrero, on September 26 and 27, 2014, and later dates. The crimes for which the arrest warrants were issued are for organized crime, forced disappearance, torture, homicide, and crimes against the administration of justice. The accusations, in each case, will be disclosed in the corresponding criminal proceedings, and compliance with the arrest warrants will also be reported at the procedural moment authorized by law.

Normalista students offered a press conference immediately after the FGR announced the arrest of Jesús Murillo Karam.

Normalista Students

"It is important to emphasize that the government and the investigations are making it clear that our comrades were murdered," said one of the normalista comrades in front of the microphone. “We have respected the slogan: until we know where they are, the slogan will continue to be: they were taken away alive, we want them alive. We are still looking for our partners.”

The students of the Rural Normal School of Ayotzinapa emphasized that the Army and the Navy were involved in the event and decided not to intervene in the disappearance: "They were present and they were watching and they never did anything. The army had an infiltrator in our comrades. They knew what was going on with the normal The betrayal of the army let them disappear. They didn't care about even one of its elements."

Regarding the military infiltrator, the students made reference to Julio César López, who reported on the activities of the students, but who also disappeared along with the other students. This was confirmed by the head of the Commission for Truth and Access to Justice at the same conference. With the new arrest warrants, the search for those responsible for the events that occurred in Ayotzinapa almost eight years ago was confirmed, especially now after it was revealed that government authorities were highly involved.

The Undersecretary for Human Rights, Alejandro Encinas acknowledged that among the 33 people involved in the case of the disappearance of the Ayotzinapa normalistas, there is neither former President Enrique Peña Nieto nor the former head of the National Defense Secretariat, Salvador Cienfuegos.

Eight years after the disappearance of the 43 normalistas, Encinas pointed out that until his most recent report, none of the two former federal officials are identified as direct participants in the disappearance of the young people; however, he did not rule out or affirm that Peña and Cienfuegos be investigated for possible omissions in the investigation of the case or for their alleged participation in the so-called "historical truth."

“Of the orders that the Prosecutor's Office is processing, there are characters from all sectors, but not from Peña Nieto,” he assured during the report's question and answer session. "The investigation continues, of course, it is being carried out based on who built the historical truth and who ordered that it be implemented," he added.

The version given by the Segob of the previous administration has many differences from the new information report presented by Alejandro Encinas.

Truth Commission

The Truth Commission, created to clarify the disappearance of 43 students in southern Mexico, also specified in its report that what happened eight years ago was "a State crime" and that it sees responsibility in the Army for not having acted despite the fact that one of the young men was a soldier infiltrated in the student group and knew what was happening.

He also said that the Army is responsible, at least, "by action, omission or negligence" in the case because one of the disappeared youths was an infiltrated soldier whom his commanders did not look for, although they had real-time information on his situation, and that inaction went against the current protocols. Among some of the conclusions, it was stated that there was a coalition between members of the Guerreros Unidos criminal group and agents from various institutions of the Mexican State, such as federal, State, and municipal authorities.

In an interview with Aristegui Noticias, Encinas clarified that the demarcation of responsibilities between Enrique Peña Nieto and General Cienfuegos corresponds to the so-called "Night of Iguala"; that is, strictly to the direct aggression and disappearance of the students, not to the omissions and irregularities that were presented by the past administration as "Historical Truth".

Differences from Historical Truth

In this sense, Encinas denied the veracity of the so-called "Historical Truth", which pointed out that the students of the Ayotzinapa Normal School were deprived of their liberty by members of the Guerreros Unidos criminal group, because they allegedly belonged to Los Rojos, an opposing group. It was claimed that the students were later burned in the Cocula garbage dump.

There are several differences between Murillo Karam's so-called "Historical Truth" and the report presented on August 18 by Alejandro Encinas, where military participation was reported.

1. It was pointed out that the students sought to boycott the work report of María de los Ángeles Pineda Villa, then president of the DIF and wife of José Luis Abarca Velázquez. However, it was stated that the students were actually going to take buses to Mexico City to commemorate October 2, 2014.

2. The "Historical Truth" determined that the students detained by the Iguala police were taken to the entity's headquarters. However, with the information presented this Thursday, August 18, it was stated that the students insured by the Iguala municipal police in Juan N. Álvarez, were the ones who were on board bus 1568 and were transferred to his headquarters.

Also, in the securing of the students of the bridge in front of the Palace of Justice, of bus 1531, the municipal police of Iguala and Huitzuco participated. “Initially, the intention was only to give the students a 'fuck' because 'A1', that is, a plaza boss who did not want to identify himself, was not looking for disturbances, in addition to recovering material, which apparently came in one of the buses,” the report reads.

3. In the first version, it was deduced that the students were abducted from the Iguala Comandancia by municipal police officers from Iguala and Cocula and handed over to members of Guerreros Unidos in Loma de Coyotes. While in the information presented this Thursday it was clarified that they were the students of truck 1568.

The "Historical Truth" indicated that the first delivery consisted of four people, one of whom was dead, and they were transported in a pick-up truck. Later, a second delivery was made of 35 to 40 people who were transported in a three-and-a-half ton truck owned by “El Gil”. On the contrary, Segob indicated that the students from truck 1531 were seized by the Iguala police and taken to Loma de Coyotes, while those seized by the Huitzuco police were taken to that entity.

A protected witness mentioned that all the students were asked to take photographs since it was believed that among them were people from Los Rojos. Of all the students, only three of them were of interest to their superiors, among whom were "El Cochiloco" and "El Chilango".

4. According to Murillo Karam, the disappearance of the students was carried out on the instructions that “El Gil” transmitted to “Brush” through “Fercho”, in charge of the assassins of Guerreros Unidos in Cocula.

However, this contrasts with current information where it was reported that "A1" gave the order to recover the merchandise: "Fuck everyone at my discretion." “A1″ ordered the disappearance of all the students because they don't know “who is who” and the square is getting too hot: “Kill them all, Iguala is mine”.

5. The “historical truth” affirmed that the members of Guerreros Unidos cremated them in the Colula garbage dump because they were supposed members of the opposing group called Los Rojos. The original instructions were to burn the students, but since there were so many of them, they decided to distribute them, so “El Chuky” put a “machete” on them and put them in bags so that each group could dispose of them as they wished.

Until now, the method of execution of the group of students that were taken to Huitzuco is unknown. In this sense, the hit man Eduardo N, alias "El Chuky" was identified as the one who killed and tortured the student Julio Cesar Mondragón "El Chilango", even without having instructions from his superiors, it was written in the report.

The operators of the disappearance of the students were: “El Gil”; "The black"; "Tito"; "The Chinese"; “El Pato” Landa and his people; "The cholo"; "The monkey"; "The fat girl"; “The Duvalín or “Duva”; "The Tony"; "The chicken"; “El Cuca”; "The ugly one"; "The Wasako"; “Memo” (cousin of “El Chino”); “El Moreno” (a chef from Guerreros Unidos) and “H1″ Huitzuco police commander.

6. One of the most controversial issues was that the remains turned to ashes were placed in black bags that were thrown into the San Juan River. But the new report confirmed that on the day of the events, six students were alive and were being held in La Bodega Vieja. On September 30, “El Coronel” commented that they would be in charge of cleaning everything and that they had already taken care of the six students who were left alive.

Regarding the last point, the current information confirmed that the remains were moved to a second destination. Regarding the first location, it is known that:

-“El Chino” threw his “packages” into the Balsas River
-“La Gorda” took them to the Pueblo Viejo well with the support of “El Cuca” and “El Feo”
-"El Moreno" was asked to cook 10 students, but due to lack of material he only cooked five, the rest he sent to "El Chuky"
- Other students were displaced to Huitzuco's house; it is still unknown who made the move
-"El Chino" commented that even in "the bosses' mine" they threw people

The report highlighted: "In subsequent days there was a meeting with Albarca and the 'advisors from Mexico' so that they could clean up." In addition, it was assured that they kidnapped an engineer from Chilpancingo to banish the bodies and took them to the second destination in 27 Batallón, to the rancho del Cura, Lomas de Coyote, and La Mina.

Jesús Murillo Karam was known as the creator of "the Historical Truth" of the Ayotzinapa case, raised on January 27, 2015, and where he reported that the 43 students were burned in the Cocula dump, as a result of a "spontaneous" phone call. For their part, the parents of the disappeared students as well as the investigators of the Interdisciplinary Group of Independent Experts (GIEI) rejected the conclusions of the prosecutor, who resigned from his position in February 2015.

In addition, on September 25, 2015, deputies from the Party of the Democratic Revolution (PRD) filed a lawsuit for impeachment against the former head of the PGR on the grounds of serious violations of the law during the investigation of the Ayotzinapa case.

Finally, it was reiterated that with the "Historical Truth" he built a narrative that forced and manipulated the justice system in order to avoid a thorough investigation that would allow the truth of the facts to be known.

Former Attorney General Jesus Murillo Karam was responsible for the investigation of the disappearance of the 43 normalistas from Ayotzinapa, which occurred on September 26, 2014, in Iguala.

Former Attorney General Arrested

Police personnel from the Attorney General's Office (FGR), complied with the arrest warrant requested by this Institution and granted by the Control Judge of the Federal Criminal Justice Center in Mexico City, based in the North Prison, against Jesús Murillo Karam, who was the Attorney General of the Republic, for the crimes of forced disappearance, torture and against the administration of justice, in the “Ayotzinapa” case.

The Attorney General's Office (FGR) reported that the former official during the administration of Enrique Peña Nieto was arrested this Friday outside his home in Lomas de Chapultepec, in Mexico City without any problem; since he collaborated with the police authorities without resisting, once he was informed about the procedure that was being carried out. Tactical and operational support was received from specialized personnel of the Secretary of the Navy-Navy of Mexico (SEMAR).

The detainee has been transferred to the facilities of the Prosecutor's Office for the corresponding certifications; and immediately he will be placed at the disposal of the judicial authority, in compliance with the aforementioned arrest warrant. After the arrest of the former prosecutor, the spotlights are on another of those involved in the "Historical Truth": Tomás Zerón de Lucio, who was head of the Criminal Investigation Agency (AIC) and right-hand man of Murillo Karam, for what is investigated for the same crimes. The latest reports indicate that he is now located in Israel.

  2. “Historical Truth?” That’s the new punch line to describe this barbarity, the years long lies, and the filthy corrupt powers/elites that covered up the butchery of these young people. Sadly, there have been countless atrocities like this in collusion with the Mexican gov/forces. Meanwhile, the butchers continue to be glorified due to fancy cars, money, and paid women on their arm. This is accepted, this is cheered on, this is normal, this is Mexico! Wake the fuck up Mexico! How’s those gun laws working out for you? Arm yourselves! Don’t fucking blame USA! Blame your pathetic gun laws. Blame the monsters and those that cheer them on. Blame the corrupt presidents and politicians! Blame yourselves!

    2. 5:24 You're obviously retarded. People in Mexico have armed themselves many times to oppose cartel violence (e.g., the various Fuerza movements), but -- just like law enforcement -- they're usually outgunned, outspent, and infiltrated by the cartels.

Even if every Mexican citizen had a rifle or handgun, it would do absolutely nothing against the paramilitary approach of the cartels.

Of course the US plays a role in all of this! With its disproportionate appetite for drugs it offers the largest drug market in the world, which in turn has created insane profit margins that fuel the entire drug industry. This is why criminals in Mexico are willing to do anything to protect their share of this billion-dollar industry!
