US Judge Dismisses Mexico's $10 Billion Lawsuit Against Gun Makers, Mexico to Appeal

A U.S. judge on Friday dismissed Mexico's $10 billion lawsuit seeking to hold U.S. gun manufacturers responsible for facilitating the trafficking of a deadly flood of weapons across the U.S.-Mexico border to drug cartels.

The decision by Chief Judge F. Dennis Saylor in federal court in Boston is a victory for Smith & Wesson Brands Inc., Sturm, Ruger & Co. and others accused of undermining Mexico's strict gun laws by designing, marketing and selling military-style assault weapons that cartels could use.

The main argument was that these companies have promoted "negligent and illicit" business practices that facilitate illegal arms trafficking to Mexico. According to figures included in the document presented to the United States court, each year up to 500,000 weapons are trafficked from the US and, in 2019, they could have been behind around 17,000 intentional homicides throughout the world.

Mexico said it would appeal the decision.

"This suit by the Mexican government has received worldwide recognition and has been considered a turning point in the discussion around the gun industry's responsibility for the violence experience in Mexico and the region," Mexico's foreign ministry said in a statement.

Saylor said federal law "unequivocally" bars lawsuits seeking to hold gun manufacturers responsible when people use guns for their intended purpose. He said the law contained several narrow exceptions but none applied.

"While the court has considerable sympathy for the people of Mexico, and none whatsoever for those who traffic guns to Mexican criminal organizations, it is duty-bound to follow the law," Saylor wrote in a 44-page decision.

Other defendants included Barrett Firearms Manufacturing Inc, Beretta USA Corp, Colt's Manufacturing Co and Glock Inc. Representatives for the companies either declined to comment or did not respond to requests for comment. Lawrence Keane, the general counsel of firearm industry trade group National Shooting Sports Foundation, welcomed the dismissal of the "baseless lawsuit."

Hackers Leak Thousands of Files from SEDENA, Including Culiacanazo Reports

On the night of Thursday, September 29, one of the biggest violations of the Mexican Government's cybersecurity systems occurred, a group of hacktivists managed to penetrate the systems of the Secretary of National Defense (Sedena) and access thousands of documents. confidential.

Culiacanazo Reports

One of the documents reveals how the children of Chapo Guzmán "bent" the Mexican government in the operation known as Culiacanazo, which occurred on October 17, 2019.

In one of the emails reviewed, a special part of the Culiacanazo is given as an example so that the members of the National Guard write this type of report in this way. The document summarizes what happened:

"The military report explains that two minutes later, 'the security forces invite Ovidio to persuade his brothers to cease their hostile attitude', and that for this he communicated directly with "Iván Archivaldo Guzmán Salazar, ordering him to order the cessation of the attacks, but his brother responded with a refusal and made threats against the military personnel and their families".


The leaked report states there were nine and not eight dead from the Culiacanazo on October 17, 2019. 

Sedena had assured that there were eight deaths, but internal reports indicate an additional victim, whose charred remains and bodies with bullet wounds were in official local police units, as well as in a National Guard truck.

The military report states: "At 7:30 p.m., the order was received from the Citizen President of the Republic to cease the operation to arrest Ovidio Guzmán López."

Although the official narrative is not modified, the schedule details open questions about the duration of the operation. At the time, President López Obrador justified that if he had not released the son of Chapo Guzmán, up to 200 people would have died. A week after the events, part of the justification was that the search warrant was not obtained on time, but lack of planning was also accused and support from the US Department of Justice.


Clash Over Security Policies

One more piece of information that Latinus reveals is that there is a letter from the Secretary of the Navy, Admiral Rafael Ojeda, to the Secretary of Defense, General Luis Crescencio Sandoval, in which they show their differences on security at the Mexico City International Airport (AICM), dated June 22.

Another national security fact that they released is how many Army personnel are stationed at each of the Tijuana border crossings, and at each tactical point.

They emphasize that on the southern border, in Cancun, the case is "especially serious," according to Latinus' note, since in the Cancun airport terminal the Defense admits that the optimal thing is to have 56 elements, but there are only 14. Guacamaya Hackers

They also shared a statement that branded the Prosecutor's Office as one of the most corrupt organizations.

Of supposed Central American origin, the organization denounces "five centuries of genocide, terricide, looting and rape" in the territory of "Abya Yala", as it calls America. In this context, and in accordance with the background of various sites specialized in hacktivist groups, Guacamaya protests against military interventions and large mining and oil companies, among others. Normalistas May Have Been Alive Until October 4

A part of the 43 Normalista students from the Normal Rural school of Ayotzinapa who disappeared on the night of September 26, 2014 could have been alive up to a week later, according to audios and documents from the Secretary of National Defense (Sedena), revealed the Group of Interdisciplinary Independent Experts (GIEl).

The Group indicated that in official encrypted texts found during the review of Sedena files, it is established that military commanders may have been aware of the location of the Normalistas until October 4, that is, a week after the disappearance of the students.

"These files that we found in Sedena show that on September 26 and October 4 there were telephone interceptions that talked about the young people, that talked about where the young citizens had to be sent, and some of them are from October 4, that is, several days after the events. These communications show that a portion of the young individuals would be alive in those days," explained Carlos Beristain, a Spanish doctor and psychologist, who was part of the Truth Commission in Colombia.

In his report, the GIEI specialists emphasize that these "technical telephone interventions" were not proportionate to the investigation or the search for the disappeared.

"The documents confirm that the Army (as well as the Cisen) had intervened the communications of relevant actors in the events, even when they were occurring, without judicial authorizations for this or the full content of the same is known," the document states. .

"In a Sedena document dated October 5, 2014, some of these interventions from September 26 and October 4, 2014 are included. This means that the military and Cisen authorities were informed in real time of what was happening. However, this information was not shared with the authorities in charge of the investigation, nor is there evidence that any specific search activity had been carried out," he adds.

The Fuerzas Especiales Barrera (F.E.B.) or Barrera Special Forces is an armed criminal cell in service for the Sinaloa cartel from the state of Durango. Online chatter at this time suggests that an individual with the surname of Barrera is who leads the FEB. Numerous pictures and videos of their murderous exploits have been circulating online for several months now. 

It is this writer’s belief that the San Ramón words inside their morale patch is a reference to an area of engagement in Zacatecas where they currently have their armed conflict against the Jalisco New Generation Cartel. At this time it’s unknown if these men or their chief enforcer are still alive.

Zitácuaro, Michoacán: CJNG Kills Two For Their Refusal To Pay Extortion Fees

CJNG murders two in Zitácuaro for not paying extortion; murder attributed to "El Barbas

Two murdered subjects were found aboard a pickup truck in the community of Zirahuato, municipality of Zitácuaro, with a narcomessage signed by "El Barbas", leader of "Grupo X" belonging to the Jalisco New Generation Cartel (CJNG).

Elements of the Civil Guard were alerted to a report of a confrontation in the aforementioned community. Upon arrival at the site, they found a gray Chevrolet Corsa utility truck with two dead crew members and a narco message.

The narco-message reads: "This will happen to everyone who doesn't pay the fees. Sincerely, El Barbas Grupo X".

El Barbas is a member of the CJNG, who is identified as an operator of this criminal group in Sinaloa and Veracruz.

In Michoacán, he is said to be the leader of "Grupo X", belonging to the CJNG, which disputes criminal operations against the Los Correa Cartel, La Familia Michoacana and Carteles Unidos.

Two decapitated bodies were located on the way to Borregos, a community near the district. 

On the way to Borregos, in the Villa de Pozos region this morning two corpses were found, tied up and with traces of torture.

The discovery was made by a lady who, after taking several children to school, found the two bodies on the road between Borregos and Rancho Tanque Tenorio.

Authorities deployed a security operation in the area. The Prosecutor's Office is currently investigating.

Sinaloa Cartel Lieutenant Captured In Chihuahua

"El Beny" faces weapons charges after arrest in Cuauhtemoc, Mexico

Mexican police say they captured the lieutenant of a Sinaloa cartel cell operating in Western Chihuahua.
A task force of state police officers and Mexican National Guardsmen on Friday arrested Benigno O.M., a.k.a. “El Beny,” on weapons charges. Authorities describe the suspect as a leader in the Sinaloa cartel’s Gente Nueva del Tigre cell in Western Chihuahua.

The officers and soldiers allegedly found a loaded 9 mm gun, extra gun magazines and loose ammunition for a large-caliber semiautomatic rifle. They also seized a white 2015 Jeep Grand Cherokee with an altered vehicle identification number. The arrest took place in the town of Cuauhtemoc, 360 miles south of El Paso.

El Beny “has been identified as an important part within the structure of the criminal group mentioned,” the Chihuahua Attorney General’s office said in a statement on Monday.

Gente Nueva is a Sinaloa cartel cell involved in a struggle against the former Juarez cartel (La Linea) for control drug trafficking routes from Chihuahua to the United States. The two groups clashed in the town of Las Varas, Chihuahua, in April of 2020, resulting in the death of 19 people.

The Mexican army last October arrested Francisco Arvizu, a.k.a. “The Jaguar,” who was the last known top commander of Gente Nueva in Western Chihuahua.

Austin, Texas: Former Fort Hood Army Sergeant Sentenced for Fentanyl Distribution

Last week, U.S. District Judge Lee Yeakel sentenced Eri Gutberto Parra-Lopez, 25, of Phoenix, AZ, to 72 months in prison for distributing fentanyl.


According to court documents, between May 2021 and July 2021, Parra, a then active-duty Army Sergeant stationed at Fort Hood, sold approximately 3,150 tablets of fentanyl, weighing about 3,349 kgs., to undercover officers in and around the Austin area. On April 20, 2022, Parra pleaded guilty to one count of distribution of fentanyl.


“Fentanyl is flooding the United States at an alarming rate and our communities in Central Texas are not immune from its devastation,” said U.S. Attorney Ashley C. Hoff. “This case underscores our resolve to address the dangerous trafficking of fentanyl with all available resources. We will continue to prioritize and prosecute crimes involving this deadly poison and we are thankful for the outstanding work of our local, state, and federal partners.”


“This case demonstrates the lengths Mexican cartels are willing to go to infiltrate our communities with deadly fentanyl for their own selfish gains,” said Drug Enforcement Administration (DEA) Special Agent in Charge Daniel C. Comeaux of the Houston Division. “We remain committed to our collaborative efforts with our local partners to reverse the overdose and poisoning epidemic and bring to justice those fueling it.”


“This sentencing is the result of the great teamwork we have with our local, federal and state law enforcement partners,” said Special Agent in Charge Maria Thomas of the Department of the Army Criminal Investigation Division (CID). “Army CID and our partner agencies take the threat of fentanyl to the public, and the Army, very seriously. We will continue to work with our law enforcement partners to interdict the distribution of fentanyl wherever it may occur.”


The DEA, Pflugerville and Austin Police Departments, and Army CID investigated the case with assistance from the Travis County Sheriff’s Office.

Several Oxxo Corner Stores Close After Receiving Threats In Irapuato, Guanajuato

After receiving written threats on the night of September 26, Oxxo convenience stores closed for the night in Irapuato, Guanajuato. According to TV Consecuencias, messages saying "paisano you must join up" were posted inside the businesses around 7 p.m.. 

The meaning likely was, "join us or else". It is possible criminal groups are exerting pressure on businesses to pay extortion fees, assist with money laundering, or act as spots to sell drugs or stolen gasoline.

One photo shows two National Guard soldiers standing guard on the street. He reported TV Consecuencias reported that 90% of the Oxxos in the city closed. There are at least 30 Oxxo convenience stores in Irapuato.

Neither Oxxo or local authorities have acknowledged the event.

These threats come just over a month after CJNG members burned over two dozen Oxxo stores across the state of Guanajuato in retaliation after the government attempted capture of their leader, as reported by Borderland Beat. According to El Sol de Irapuato, 13 of those were in Irapuato.

Alleged Gulf Cartel Capo Nazario Cavazos De Luna "Big Papa" Extradited to United States

The attorney general's office of Mexico (FGR) extradited an alleged former Gulf Cartel leader Nazario Cavazos De Luna "Mike", "Big Papa" to the United States, according to a FGR press release on September 26, 2022. He will face charges of of criminal association, organized crime, money laundering, and possession and carrying of a firearm from the Federal Court of the East District of Texas. 

The FGR press release claims that Cavazos was a leader and founder of a criminal organization which smuggled large quantities of narcotics to the US between 2005 and 2010. According to the US government, Cavazos was a major figure in the Gulf Cartel who attracted the DEA's attention at least as early as 2011, when a court document referenced him as "a wealthy, large scale international drug trafficker and, apparently, the center of the criminal organization".

In a 2012 case, another Gulf Cartel officer, Oscar Cantu-Ramirez, claimed that he worked with Cavazos to transport and distribute thousands of kilos of narcotics into the US.

A US Justice Department press release said that he was based in the United States, but fled to Mexico, where he was captured by the PGR in Mexico City in 2017.

A Congressional Research Service report from this year shows that extraditions from Mexico to the US are on a downward trend since the Felipe Calderon presidency, further indicating a rough patch in US-Mexico security cooperation.

Alleged CDS Banner Announces They Are At War With the CSRL

Identical narco message banners signed by the Sinaloa Cartel (Cártel de Sinaloa, CDS) in which they allegedly announced their intention to end the Cártel Santa Rosa de Lima (CSRL) have appeared within at least nine municipalities in the state of Guanajuato.

Nochistlán, Zacatecas: CJNG Enforcers Hold An Entry Control Point

A group of hitmen, alleged members of the Jalisco New Generation Cartel (CJNG), filmed themselves with a drone while they were in the vicinity of a gas station in Nochistlan, Zacatecas. 

The images show a Improvised Armored Fighting Vehicle (IAFV) that has been captured on film elsewhere circulating in a convoy in the city of Apulco.

Throughout the duration of this broadcast several enforcers and their vehicles are positioned on a two lane road in what appears to be an Entry Control Point (ECP). 

The sole purpose of an ECP is the visual monitoring of all moving traffick through the area. Each vehicle and its occupants seems to have been strategically positioned far away from each other. 

It is this writer’s belief that this was done to avoid falling victim inside a kill radius should bombs rain down from an opposing drone in a potential aerial attack.

Javier Garduño: Cristhian Josué Rivera Téllez aka El Cris, identified as the alleged leader of a cell of the Jalisco New Generation Cartel, was arrested in a house in the Monte de Piedad neighborhood in the Coyoacán district of Mexico City.

"El Jalisquillo" as he is also known is attributed to the transfer of drugs from Colombia to Chiapas. In addition to storage, sale and distribution in the capital of the country, Jalisco, Baja California, Australia, and the United States.

U.S. Customs and Border Protection officers seized hard narcotics in two enforcement actions that totaled over $11,400,000 in street value.

“CBP continues to work with our law enforcement partners to foil illicit transnational criminal organization attempts to smuggle their product through our cargo facilities,” said Port Director Alberto Flores, Laredo Port of Entry. “These significant seizures are prime examples of how CBP’s border security management aids in preventing prohibited contraband from crossing the border.”

The first seizure occurred on Tuesday, September 20, 2022, at the World Trade Bridge when a CBP officer referred a 2007 Wabash National trailer carrying a shipment of brooms for a secondary inspection. The truck was referred for a canine and non-intrusive inspection system examination, resulting in the discovery of 32 packages containing 80.73 pounds of alleged cocaine within the trailer. The narcotics had an estimated street value of $1,077,946.

The second seizure occurred later that evening when a CBP officer referred a 2004 Transcraft trailer manifesting a shipment of sheetrock for a secondary inspection. The truck was referred for a canine and non-intrusive inspection system examination, resulting in the discovery of 71 packages containing 31.39 pounds of alleged heroin and 2,551 packages containing 1047.19 pounds of suspected methamphetamine within the sheetrock. The narcotics had an estimated street value of $10,412,400.

The narcotics seized in both incidents had a combined estimated street value of $11,490,346. CBP seized the narcotics. U.S. Immigration and Customs Enforcement-Homeland Security Investigations (ICE-HSI) special agents are investigating the seizures.
