A federal judge will determine whether the appeal filed by Ismael Zambada Imperial, known as El Mayito Gordo, the son of Ismael El Mayo Zambada, against the 10-year prison sentence he was given for the crime of carrying firearms for the exclusive use of the Armed Forces, reported Milenio.
El Mayito Gordo was arrested in 2014 after elements of the Mexican army hunted his father in the southern region of Culiacan.
When they failed to find Mayo Zambada at a home they secured, El Mayito Gordo fled the house and hid in a shack where he asked neighbors to hide him. But by then elements of the Mexican army already had him located, and soon after he was arrested.
Two years later, in 2019, he was extradited to the United States, where authorities wanted him for trafficking large shipments of cocaine, heroin, methamphetamine and marijuana between May 2005 and July 2014.
Zambada Imperial, who was formally released from a U.S. prison on July 21, ultimately did not assert his right to be repatriated to Mexico and instead agreed to remain in California where he remains on parole, subject to the instructions of that state's parole authorities.
The operation by the Navy special forces that captured Mayito Gordo in Ranchito de los Burgos is the closest they have been to capturing Mayo Zambada... maybe Mayito Gordo stayed behind so his father could get away. It was reported that an attempt to rescue like the Culiacanazo was made, but the Navy wasted no time and took Mayito Gordo to CDMX.

DeleteThis situation is the fault of U.S. prosecutors. They need to bring in Mexican authorities on these cooperation agreements.
ReplyDeleteNow Mayito Gordo is in legal limbo. If he is returned to Mexico or voluntarily returns and is killed, this will really hinder future cooperation with U.S. authorities.
Each country must appoint senior attorneys to coordinate these cooperation agreements so criminal charges are settled in both countries. These attorneys must have direct access to the presidents and attorney generals of both countries.
Mayito Gordo's best bet is if a different Mexican president agrees to honor the cooperation agreement made with the U.S. and dismiss the charges in Mexico against him.

ReplyDeleteI'm not sure if Mayito would be killed. Even if he served the 10 year sentence in Mexico and lived, he wouldn't get the full benefit of the deal. In the U.S., the charge for the 10 year sentence would have been dismissed. This was absolutely poor planning on the part of U.S. prosecutors. His charges in Mexico should have been negotiated as part of his plea.
The U.S. has an extradition treaty with Mexico that it is supposed to honor. In this case, he should have been deported. Now this case is a thorn in the side of U.S.-Mexico relations and could lead to Mexico refusing to extradite criminals to the U.S. in the future.
