Journalist Luis Chaparro shared on his social networks the first photo of Ovidio Guzmán López, alias "El Ratón," dressed in orange, prior to his first hearing before a federal court in the United States following his extradition.

In the image published by the journalist, Guzmán López can be seen confused, prior to the hearing where he pleaded "not guilty.

Chapo Guzmán's son was extradited to the neighboring country on September 15, where he is accused of five drug trafficking-related charges.

El Raton is accused of conspiring to distribute drugs, being part of a criminal enterprise, exporting narcotics to the United States, carrying out financial transactions with the proceeds of illegal activities and unlawfully using and carrying firearms.

The first image was released by Derek Maltz, a Drug Enforcement Administration (DEA) official, and corresponds to the moment when Guzmán López was on the plane that transported him to Chicago.

    but is this just considered in questionable taste, or is this actually against any regulations?

      This is a violation of DOJ regulation 1-7.610F. They are not supposed to release any photos of criminal defendants unless it serves a law enforcement purpose.
      I was surprised that the airplane photo was released by a retired DEA agent. He knew better than that. He probably figured that he was no longer obligated to follow DOJ policy because he was retired, which is true because he is a civilian, but he still knows what DOJ policy is.
      If this was taken on a Mexican transport aircraft and the photo was taken by Mexican officials and not passed through DOJ hands, then it doesn't violate DOJ policy because foreign officials and civilians aren't covered by DOJ policy.
      The orange jumpsuit photo is different. This appears to be his booking photo. This was released in direct contravention of DOJ policy whether it was released through the BOP, the DEA or any other DOJ official.
      A complaint can and should be filed to the OIG.
      Ovidio Guzman can argue that he was prejudiced by these photos in court. That is why their release is prohibited by the DOJ because they could prejudice his trial.
      Most states don't view this as prejudicial to the defendant, but federal courts are more firm on guarding a defendant's rights. I'm sure this will piss the judge off, but there's nothing he can do about it because you can't unring a bell or stop the publication of a photo once it's on the internet.

    1. Unlikely. He was extradited in only 8 months. If Chapo is on board with him getting out of the game he will get significant phone time with him and he will get face to face visits with family. After a couple years in ADX Florence he will probably do anything for a face to face visit or phone calls to family. A good sign that Chapo is encouraging him to cooperate is if he gets a visit from his mother. She is barred from entering the U.S. because she is the immediate family member of drug traffickers. However, that could be waived.
