"Morogris" for Borderland Beat
After this announcement was made, another judge ordered to stop this release, which you can read here.
Jose Alberto Garcia Vilano, alias La Kena or Ciclon 19, was arrested this month and sent to the Federal Social Readaptation Center No. 1 (Altipano), Mexico's maximum-security prison. |
A court in Tamaulipas has ordered the release of José Alberto García Vilano, also known as La Kena or Ciclón 19, the leader of the Matamoros faction of the Gulf Cartel, who was recently captured near Monterrey.
The judge Crescencio Contreras Martínez explained that La Kena was due to be released for lack of sufficient evidence presented by Mexico's Attorney General's Office (FGR) and procedural errors in their investigation presented before the court.
As of the latest information available, it remains unclear whether this release order has been executed and if La Kena has been set free.
In response to these events, the FGR has asked the Secretariat for Home Affairs to investigate and impeach Judge Contreras Martinez for his favorable rulings toward cartel members. Nevertheless, a judge association criticized this action, asserting that the judge acted in accordance with the law.
The Case and Its Unraveling
The case fell apart when authorities found a driver's license with the name Jose Alberto Garcia (La Kena's name) at one of the properties seized days after the arrest. The FGR used this ID card to press charges, but the ID was fake. They also asserted before the judge that the address on the card was La Kena's residence (though it was not).
The judge criticized the FGR, stating that they should have cross-checked this information and conducted a thorough investigation to confirm if the mentioned address was indeed La Kena's official residence.
During his initial hearing, La Kena was charged with illegal possession of firearms and organized crime involvement with the intent of drug trafficking. In other words, his organized crime activity was considered a means to an end (the "end" being drug trafficking). However, the judge ruled that the FGR failed to prove his connections to drug trafficking and organized crime altogether.
Despite the discovery of drugs in the seized residences, the judge deemed it insufficient to establish La Kena's direct involvement with the Gulf Cartel. The judge said that the drugs seized show signs of drug possession but do not indicate an intent to distribute, let alone any evidence suggesting cartel connections.
In March 2023, the FGR presented a case against La Kena before the judge, alleging his involvement with the Gulf Cartel and his responsibility for the kidnapping of 31 migrants. However, following La Kena's arrest, the FGR did not provide additional evidence for these charges.
Narco-banner
On January 25, Alerta Tamaulipas 2 shared a picture of a narco-banner erected by cartel members in Ciudad Victoria where they alluded to the possibility that La Kena could be released from prison.
The banner reads:
Attention Government of Mexico and Government of the United States of America
The people of Mexico hereby ask you to supervise the judge or judges who are handling the trial of Jose Alberto Garcia Vilano, alias La Kena, Ciclon 19. It is very likely that the crime of organized crime involvement will be removed and that La Kena may seek freedom.
We know that Mexico is infested with corruption and that is why feel vulnerable with the decisions of those who administer justice.
It is also known that the transfer of La Kena to the Matamoros state prison has already been ordered, and that his escape is being planned from there. Therefore, we ask tha La Kena continues to be imprisoned at Altiplano prison and that his extradition process be expedited so that this person stops causing harm to the people of Mexico.
Please give your attention and immediate involvement, Federal Judiciary Council.
Why are capos being freed?
The recent release order for La Kena follows a similar pattern observed with Axel Alfredo Cárdenas Rodríguez, a Gulf Cartel member and the son of cartel leader José Alfredo Cardenas Martinez, also known as El Contador.
This trend points to a recurring challenge faced by Mexican prosecutors in gathering evidence against suspects. The historical struggle predates the adoption of Mexico's New Criminal Justice System (Nuevo Sistema de Justicia Penal, NJSP) in 2016. Before the NJSP, the judicial system allowed authorities to detain suspects preventively (arraigo) for up to 80 days, providing time for the prosecution to gather evidence and build a case.
However, with the reduction of arraigos under the NJSP, prosecutors now need to have cases prepared before making an arrest. Any flaws in the case can result in the suspect's quick release from prison. The shift has required police investigators to adapt to a more meticulous approach, as lawyers scrutinize cases more carefully.
La Kena's release may also imply the involvement of a skilled legal team proficient in navigating federal court systems and obtaining favorable rulings from judges. This assumption is drawn from the release patterns observed among other members of the Gulf Cartel Matamoros faction who have been freed from prison in recent years.

YOU GOTTA LOVE MEXICO LMFAO
ReplyDeleteFor reals lol. It’s almost comical at this point. Everyone is corrupt and they don’t care to show it
DeleteNo we don't fkin love it. This sh*t is a fkin disgrace
Delete@8.06. Not denying corruption, but it's often assumed it's the judges, when it's the investigators (tired, cynical, underpaid, undertrained and under pressure from rival groups if not actually on their payroll) that fuck it up, and the judge is right, and as furious as everybody else.
DeleteMetros and ZVE so scared of him they where snitching on him bad on that manta 😂😂
ReplyDeleteComandante Nico and chuy have San Fernando on lock and do not fear the rat la kena...he will be killed if released
DeleteIf it wasn’t for them having back up from Reynosa and Jalisco they would have gotten eaten alive by matamoros. Moros is the root of all this stuff my family of from there lol
DeleteCual "lock" si le estan dando las nalgas a lot Michoacanos jajaja
DeletePor esos los soldados deberían darles tiro y pal río
ReplyDeleteSo who is more corrupt? FGR or judge?
ReplyDeleteTime for a Purge!
DeleteAxel Alfredo, now La Kena. Dang
ReplyDeleteCDG Matamoros made a big mistake by kidnapping for 4 gringos. The faction was rarely mentioned in national media for many years. I remember that Matamoros used to be super quiet/secretive and we hardly knew anything about them, even in the old BB forum when we would post about what was occurring there with Ciclon 7, El Cuate, etc.
ReplyDeleteThey have all the local newspapers under a tight grip but that kidnapping let hell loose with the DEA picture leaks and much more. Now the Mexican government is after them and they'll keep pressing until many of the CDG most wanted are behind bars, dead, or extradited.
You must not be from moros. There are literally hundreds of ppl working for them they will never finishing catching them when there’s always someone new
DeleteThats the thing
DeleteIts harder to catch them in their own city...
But if the arresting agency is like La Marina... Your fucked lol
Look @ hummer in Reynosa they got him @ his own stash house with guns/cash
And they tried to rescue him but they couldn't
You can not underestimate la marina
When/if they want your ass your cooked
Kenas barely feeling the heat
we'll see how he handles it dor the future
Ok now has that stopped the flow of shit of everything through matamoros or Reynosa? No. New head. Every time. You know why? The politicians are the ppl you should be worried about. Not these “bad guys”.
DeleteWith all that money I would have lasered off the mole.
ReplyDeleteThat's koo foo
DeleteBut yet el guero palma is still rotting in a Mx prison. Who do u guys think doesn’t want el guero palma out??
ReplyDeleteGüero palma is irrelevant today. Probably has money laundering already invested in real estate and shit but he’s not a key player. So he can’t pull the strings to get out.
DeleteMayo
DeleteBecause guero palma had the mexican government paid just like chapo and Miguel Ángel Félix Gallardo and probably knows alot of the corrupt politicians

Seems like la kena got some connects. But will he be given his position back or get killed by his own faction? One thing can be said. The man is a lead from the front type cartel boss. He was in the monstro that was recording the shootouts vs metros and zve you cld hear he was the one talking and barking orders with his right hand man el escorpion 45.
ReplyDeleteWhat's video is it do you have a link??
Delete@ 6:57pm
DeletePlease link videos if you can! I love being able to identify actual people from narco vids. The one video where the shoot the four dudes people were saying Kena was the interragator. He does seem to be an in the field type boss too.

DeletePeople who try to cite that case to make a point are almost always deeply uninformed about what actually happened.
The woman claims that had a drug induced psychotic episode.
Police body cam footage (shown in court) shows the woman repeatedly stabbing herself in the neck with an 8-inch serrated knife and cutting her own jugular vein. Police had to hit her 9 times with a steel baton in order to physically stop her from stabbing herself. She had to undergo surgery to survive the wound to her right jugular.
In addition to stabbing the boyfriend and herself, she also stabbed her own dog to death.
A psychologist administered a test to evaluate if she was "faking" symptoms of psychosis and found no evidence of her "faking" it.

Hearst, I'm well aware of the case, it's the fact that all she received was probation... maybe I should provide a street racing story where the son of a wealthy business man gets minimal time and probation for killing an innocent victim trying to get home from work.
DeleteIf I stabbed somebody 108 times every time I smoked pot, there would be a heck of a lot less people in the world today, that's for sure..
DeleteC'mon, weed mellows you out, clearly this nutcase endured a psychotic episode, but let's not put the blame on smoking some dried flowers..
"No more be grieved at that which thou hast done:
Roses have thorns, and silver fountains mud;
Clouds and eclipses stain both moon and sun,
And loathsome canker lives in sweetest bud"
🦎
I'm not trying to comment on who is responsible in that case, or on what I think the sentencing should have been for her.
DeleteI just don't think a psychotic episode like that is a great parallel to a cartel figure like Kena buying himself a quick release. Intimidation, money and power is what got Kena on the streets again.
HEARST gave a good explanation, others don't know the facts like 11:58.
DeleteAnyone who doesn’t think the Mexican government is not complicit with criminals is absurdly misinformed. But but but AMLO has pursued… blah blah blah. It’s all political theater and narco politics. Your beloved AMLO accepted cartel money in the past. Mexico is a failed state but the US won’t say it because they are their largest trade partner.
ReplyDeleteSomeone talking out of their ass instead with their head 💀AMLO doesn’t make these decisions
Delete7:17 has very valid points, the president along with others that puppetized him make the decisions. It's also true ALMO has accepted bribes from Cartels, he just likes to keep it under the radar.
Delete7:17 has very valid points, the president along with others that puppetized him make the decisions. It's also true ALMO has accepted bribes from Cartels, he just likes to keep it under the radar.
Delete@11.23. No, @7.17 doesn't make any good points. Literally nothing he says is true. Mexico is not a failed state (he doesn't know what the term means), Mexico is not the largest trade partner of the US, AMLO has not accepted Cartel money (you say he kept it quiet, but you know different? Evidence of any kind wd be good). And his argument "Anybody who doesn't think the Mexican government is NOT complicit" is a double negative, saying the opposite of what I think he meant. It's the but but but dude, back with a vengeance.
DeleteAnd… this article suggesting “good lawyering” is patently absurd. Matamoros and others were largely responsible for getting Americo elected. There was another major release shortly after he took office that barely got a mention here. Lawyering has nothing to do with what’s occurring here. When the authorities actually want someone, they are pretty good at sealing the deal.
ReplyDeleteNah. It’s good lawyering too. The fact they can issue amparos after amparos and catch tiny details like that means they are paying up attorneys. Yes, corruption is involved too, even on the judges side, they are not mutually exclusive. Attorneys in Mexico charge a shit ton of money and usually want cash. I speak from experience since I’ve had several legal actions in Mexico (real estate / land cases involving accidents and illegal housing, but still). CDG had good attorneys with Osiel too, and serve as advisors, launderers, and communicators. Think of Guerrero Chapa as the best example but there’s many.
DeleteHace unos días mataron a un abogado en Reynosa. No sé si andaba metido pero tenía pedos con la maña por algo lo mataron. Los abogados andan bien metidos en casos y amparos y todo ese rollo.
Delete7:27 - It wasn't an absolute statement of fact, but it is a possibility. You seem to speak in absolutes.
DeleteDenying good lawyering is ignoring the evidence seen in El Contador's case. In 2018, his defense team was able to show through videos that the arrest didn't happen as authorities described it. For that reason he was released.
https://www.sinembargo.mx/21-02-2018/3388499
The same goes for his other releases, where El Contador's team pokes holes at everything the prosecution throws at them. Forget about all the amparos/motions they issue for pretty much anything they have. These legal moves are very expensive for the average Mexican, but El Contador has the money to dump all the defense options he has. The FGR isn't used to these types of cases since they are very costly for both sides.
CDG Matamoros has historically used attorneys for navigate court systems but also to run criminal activities. The best example is Juan Guerrero Chapa as 7:50 said, but we also have others like Galo Gaspar Perez Canales and Jesús Solano Sánchez. El Contador was around when these attorneys were active under Osiel so not surprised he learned the ropes and is employing this strategy now.
Damm México what a fuckup government it has
ReplyDeleteDang! And here I thought the escorpiones were done ✔️ 🙄
ReplyDeleteMetros better be on their toes!
CDG Matamoros showing they have pull.
ReplyDeleteHe ordered the releace because he thought he was going to snitch on him....lol..poor judgment 🤣🤣🤣
ReplyDeleteDEA is probably upset.
ReplyDeleteGood article Morogris/Mx. thanks for all you do.
ReplyDeleteYa mero sale el jefe por eso, el mata amigos. 🙏 CDG controla bajo del agua
ReplyDeleteDude is a legit mass murderer. Only in Mexico a fake ID gets a dude off. 😂
ReplyDeleteAt this point the US government needs to step in and AT LEAST help Mexico put criminal investigations together. Why doesn’t the DEA send evidence against this guy?
ReplyDelete'At this point the US government needs to step in'
DeleteWill you people grow a brain, Mexico doesn't need or want U.S help.
Fuck do you think the U.S are fuckin Dudley do right. Sort starvation out as well, dirty drinking water, the ozone, melting ice caps, the U.S
10:14 the US is the reason Mexico is like this in the first place
DeleteWorst part about it is not a single one of us are even remotely surprised about this

DeleteThe saddest, albeit truest comment of the day..
Although Kena clearly is a POS, he commands some kind of respect for actually being in the thick of the action when the bullets start flying, and walking out of the bote free as a bird after only 10 days or however long it's been truly is the stuff of legend..
Whoever ranks above him in the escorpiones pecking order probably should have him eliminated, Kena might prove to be overly ambitious, and besides, he's drawing too much heat..
🦎
Lmao if you think theres anyone above kena
DeleteThere maybe but they operate completely independent
So what does it matter what happens to Kena
Plusss Tres Letras prolly pissed @ this
They'll come @ him harder with la marina/FGR/Tres Letras
If they really want him
His arresting agency wasa joke
If I was la kena I'd be fuckin laying low & even then he showed his power
There's always going to be a targey on him by gringos now
He should retire/call it quits while hes ahead
Look @ 77 nini in culiacan lol
Best songs but you can only escape a # of times
Retirement an option, but then what, play golf, watch Netflix, listen to the wife nag?
DeleteThese maniacos are born with an extra chromosome or something, a lust for power, and addicted to the adrenaline fix that only live rockem-sockem boots on the ground action can provide ..
🦎
He'll be released and waiting outside the gates will be FGR ready for another interrogation. Kena might be hoping he's charged in México since he will probably be accused of the kidnapping and death of the USA citizens in Matamoros. That would concern the FBI.
ReplyDeleteMéxico Lindo y Jodido
ReplyDeleteThis only going to make him a bigger target if true. Last time they publicly ‘fumbled’ a narco(Caro Quintero) from prison, they went all out after him again. Specially since the gringos want him too.
ReplyDeleteDon Rafa will pass before he ever gets extradited. The same way Hector Beltran passed right before he was due to be extradited
DeleteSo...Hector self induced a heart attack?
DeleteThink the implication is that they held him over there and just delayed, so his info expired, politicians retired, and so on.
DeleteThis must be really common. Because we know that they will extradite in a few months if they are compelled. Look at Ovidio.
what I wonder is why some can circumvent the process and others can't. When political favor turns against you, when your money runs out.
Anyway nothing new here folks. What do you guys think about the Griselda series on Netflix? I kind of liked the first episodes.
ReplyDeleteI like to watch I Love Lucy.
DeleteGriselda blanco was a murdering pig. She got what she deserved. Sofia Vergara with her annoying ass accent is way to pretty to play her.

DeleteIf they have to release him do it in downtown Reynosa with advanced public notice.
ReplyDeleteSeems like Gulf cartel about to blow shit up, with the release of little Osiel and osiel Cardenas being released this year. Sounds like gulf cartel is about to get strong again. They need Kena to be out and hace everything in control, but who knows, it’s just my opinion.
ReplyDeleteThat has nothing to do with “strength” here . Strength comes from government support and complicity.
DeleteFor starters Osiel Sr will never step foot again in Mexico and Osiel Jr is a pure dumbass .. if Osiel Jr doesn’t need enemies he can and will destroy himself like the crayon-eating moron he is
DeleteThe women who had an episode, so what. Bottom line is that if they allow people to not be accountable for choosing to ingest a substance and the.
