A Collegiate Court ordered the Attorney General's Office (FGR) to return two residences and 14 vehicles, including a Lamborghini Aventador and a Porsche, seized from the Jalisco Cartel - New Generation (CJNG) after the recapture of Rosalinda González Valencia, wife of Nemesio Oseguera “El Mencho”, in November 2021 in Zapopan, Jalisco.

In resolving an appeal for review, the First Collegiate Court in Criminal Matters determined that the FGR seized the properties and vehicles without prior authorization from the corresponding control judge, in terms of the provisions of Article 252 of the National Code of Criminal Procedures, since the seizure did affect fundamental rights.

Through an agreement dated November 23, 2021, the Special Prosecutor's Office for Organized Crime (FEMDO) secured the two residences and the automobiles, as part of the investigation it initiated for the kidnapping in Zapopan of two sailors, in retaliation for the arrest of González Valencia.

Dissatisfied with this decision, the owners filed a writ of amparo which was denied by a judge, who considered that their fundamental rights had not been violated.

In view of this, the plaintiffs appealed to the First Collegiate Court, which annulled the seizure of the properties and vehicles carried out by the FEMDO, due to the fact that before carrying out “acts of investigation with the purpose of seizing the aforementioned property and the vehicles, the responsible ministerial authority must request authorization from the corresponding Control Judge, in terms of the provisions of article 252 of the National Code of Criminal Procedures”.

According to investigations by the Attorney General's Office, the two properties seized were used by the Jalisco Cartel - New Generation as safe houses and one of them was in the name of Laisha Oseguera Gonzalez, daughter of the CJNG leader.

“They are safe houses of the criminal organization known as the Jalisco Cartel - New Generation, which are used for the commission of illegal acts of illegal deprivation of liberty, both by civilians outside the organizations, as well as people belonging to various criminal organizations,” it was stated.
