Originalmente su salida de dicha prisión estaba contemplada para el 11 de enero del 2025 pero se adelantó un trimestre.
En diciembre del 2023, Cárdenas Guillen fue sentenciado a 14 años 5 meses de prisión por conspirar para distribuir y poseer con la intención de distribuir cocaína a los Estados Unidos.
Apenas a finales de agosto su hermano Osiel Cárdenas igualmente abandonó la prisión al cumplir sólo 21 de los 25 años a los que fue sentenciado en el 2010.
Pese a que Mario Cárdenas ya no se halla en la cárcel y en Estados Unidos comienza un periodo de 5 años de libertad condicionada, el también conocido como “El M1”, “El Metro” o “El Gordo”, recibió en abril de 2021 en México una condena de 20 años por delitos de delincuencia organizada en modalidad de narcotráfico, así como por funciones de administración, dirección y supervisión de un cártel.
Según el protocolo actualizado del tratado de extradición entre México y Estados Unidos, firmado en 1997 durante las administraciones de los presidentes Bill Clinton y Ernesto Zedillo, el gobierno mexicano puede reclamar a este acusado para que, una vez que haya cumplido con su sentencia texana, regrese a México a cumplir los 6 años de los 20 del castigo que no completó.
